1. Introduction

Welcome to arenarium/maps ("us," "we," or "our"). We operate the arenarium.dev website (hereinafter referred to as the "Service").

This Privacy Policy governs your visit to arenarium.dev and explains how we collect, safeguard, use, and disclose information that results from your use of our Service, including our map marker management services, API, and related services.

We use your data to provide and improve our Service. By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy. Unless otherwise defined herein, terms used in this Privacy Policy have the same meanings as in our Terms of Service.

Our Terms of Service ("Terms") govern all use of our Service and together with this Privacy Policy constitute your agreement with us ("Agreement").

  • Service means the arenarium.dev website and all related APIs, applications, and services operated by arenarium/maps.

This Usage Data may include:

  • Your computer's Internet Protocol address (e.g., IP address)

  • Unique device identifiers and other diagnostic data
  • Device type, operating system, and device unique ID when accessing via mobile device
  • API Usage: Number of marker state updates, API requests, and service usage patterns
  • Map Data: Information about map markers, locations, and configurations you create through our Service

3.4 Tracking Cookies Data

We use cookies and similar tracking technologies to track the activity on our Service and hold certain information. Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. arenarium/maps uses the collected data for the following purposes:

  • To provide you with news, special offers, and general information about other goods, services, and events which we offer that are similar to those that you have already purchased or enquired about, unless you have opted not to receive such information

5. Data Sharing and Disclosure

5.1 Service Providers

We may employ third-party companies and individuals to facilitate our Service ("Service Providers"), provide the Service on our behalf, perform Service-related services, or assist us in analyzing how our Service is used.

These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose. Our Service Providers include:

  • Polar Software Inc.: Our payment processor and merchant of record, which handles billing, payment processing, and related financial transactions. They adhere to PCI-DSS standards for secure handling of payment information.
  • Cloudflare: Our cloud infrastructure provider, which hosts our Service and stores data, providing content delivery, security, analytics, and performance optimization services.

We do not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy.

5.2 Disclosure for Law Enforcement

Under certain circumstances, we may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g., a court or government agency).

5.3 Business Transactions

If we or our subsidiaries are involved in a merger, acquisition, or asset sale, your Personal Data may be transferred as part of that transaction.

7. Data Retention

We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. arenarium/maps will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy. No transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place, including the security of your data and other personal information.

9. Your Data Protection Rights Under GDPR

If you are a resident of the European Union (EU) or European Economic Area (EEA), you have certain data protection rights covered by the General Data Protection Regulation (GDPR).

We aim to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Data.

10. Your Rights Under CalOPPA

The California Online Privacy Protection Act (CalOPPA) is the first state law in the United States to require commercial websites and online services to post a privacy policy.

According to CalOPPA, we agree to the following:

  • Users can visit our site anonymously
  • Our Privacy Policy link includes the word "Privacy" and can easily be found on the home page of our website
  • Users will be notified of any privacy policy changes on our Privacy Policy page
  • Users are able to change their personal information by emailing us at support@arenarium.dev

Our Policy on "Do Not Track" Signals

We honor Do Not Track signals and do not track, plant cookies, or use advertising when a Do Not Track browser mechanism is in place. Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked.

  • Right to Delete: To delete your personal information. If you make this request, we will delete the personal information we hold about you as of the date of your request from our records and direct any service providers to do the same. In some cases, deletion may be accomplished through de-identification of the information.
  • Right to Opt-Out of Sale: To stop selling your personal information. We do not sell or rent your personal information to any third parties for any purpose. You are the only owner of your Personal Data and can request disclosure or deletion at any time.

Please note, you are entitled to ask us to provide you with this information up to two times in a rolling twelve-month period. When you make this request, the information provided may be limited to the personal information we collected about you in the previous 12 months.

If you ask us to delete or stop selling your data, it may impact your experience with us, and you may not be able to participate in certain programs or membership services which require the usage of your personal information to function. However, we will not discriminate against you for exercising your rights.

We may use third-party Service Providers to monitor and analyze the use of our Service, including for error tracking and performance monitoring.

Our Service may contain links to other sites that are not operated by us. If you click a third-party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit.

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

14. Children's Privacy

Our Service is not intended for use by children under the age of 18 ("Child" or "Children").

We do not knowingly collect personally identifiable information from children under 18. If you become aware that a child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last updated" date at the top of this Privacy Policy.

We will let you know via email and/or a prominent notice on our Service prior to the change becoming effective.
